Collaborative Law
What is Collaborative Law?
Collaborative Law is a process of resolving disputes arising from family breakdown in a non-confrontational manner which puts the parties themselves in control of the outcome.
It is a sad fact of life that divorce and relationship breakdown are here to stay but nowadays, it is not necessary for the parties to end up in Court proceedings.
The Collaborative approach involves couples working with their Legal Representatives to try to reach agreement. The process puts the needs of any children first and enables the couple to reach solutions focused on their priorities. If agreement cannot be reached and the Court is the only solution, the Legal Representatives cannot act for either party in the subsequent Court case. This is a great incentive for all parties to strive for settlement.
At Hall Smith Whittingham we offer the Collaborative process as we believe it is a constructive method of resolving issues arising on family breakdown.
